01Who these terms are for
These terms apply between pragtex GmbH, Bodanstrasse 58, 88048Friedrichshafen (“we”), and the business or organisation that uses Craeft (“you”). Craeft is offered only to businesses within the meaning of § 14 BGB, not to consumers. People you invite use Craeft on your behalf, and you make sure they follow these terms. Your own terms don't apply unless we agree to them in writing.
02What Craeft does
Craeft lets you change your website by describing what you want, in words, by voice or by pointing at the page. It uses AI to prepare the change in a private draft; you review it; and when someone allowed to publish does so, it goes live. Craeft changes words, pages, photos, search details and the look of your website, and tells you when a request goes beyond that. Craeft also hosts your website. The technology behind Craeft may change over time; what it does for you stays the same.
03Early access
Craeft is in early access and available by invitation. Features may change, be added or be removed while we develop it, and there is no guaranteed level of availability or support unless we agree one with you in writing.
04Accounts and roles
Each person signs in with their own email address. You decide who to invite and which role they have on each site (editor, publisher or admin), and you are responsible for what happens under your organisation's accounts. Keep access to the email addresses used for sign-in secure, and tell us straight away if you suspect someone has misused an account.
05Your responsibilities
- You have the right to change the websites you connect, and to the content, photos and logos you or Craeft add to them.
- The content you publish with Craeft is your responsibility, including its legal compliance (for example your own imprint and privacy policy, copyright and advertising law).
- You check that the facts on your website (prices, opening hours, contact details) are correct before you publish them.
06Services we rely on
Craeft is built on services from other providers, for example for hosting, AI and keeping your website's history; theprivacy policy lists the current ones. Where you connect an account of your own with one of these providers, your agreement with that provider applies and it bills you directly. Where Craeft shows usage or lets you set a monthly cap, it is your job to keep any account of your own funded and the cap where you want it. We are not responsible for outages or changes at providers you contract with directly.
07Reviewing changes
Craeft's changes are prepared by an AI model and can be wrong, incomplete or not what you meant. That's why every change waits in a private draft, with before-and-after screenshots, until someone in your organisation publishes it. You are responsible for reviewing a change before you publish it. If something goes wrong, Revert takes the publish back.
08Acceptable use
You must not use Craeft to:
- publish unlawful content, or content that infringes other people's rights;
- change websites you aren't authorised to change;
- attack, overload, probe or work around the security of Craeft or the services it connects to;
- copy, resell or reverse-engineer Craeft, or use it to build a competing product.
If you break these rules, we may suspend access, where possible after warning you first.
09Your content and our software
Your website, its content and its code remain yours, including the changes Craeft makes to them. You give us the rights we need to process them to provide Craeft to you, and nothing more. Craeft itself, its software and its design remain ours; for the duration of the contract, you may use it for your own organisation and your clients' websites. If you send us feedback, we may use it to improve Craeft without owing you anything for it.
10Data protection
Our privacy policy explains how we handle personal data. Where we process personal data on your behalf, for example personal data in your website's content, we do so as your processor; we'll conclude a data processing agreement under Art. 28 GDPR with you on request.
11Fees
Fees for Craeft, including hosting, are agreed with you separately before they apply. Charges from providers you contract with directly are separate and billed to you by them.
12Availability and changes
We work to keep Craeft available but can't guarantee it will run without interruption; maintenance and the services it depends on may cause downtime. Because Craeft never runs on your live website, an outage of Craeft doesn't affect your visitors. We may update these terms; we'll tell you about material changes at least four weeks in advance, and you can end the contract before they take effect.
13Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act (Produkthaftungsgesetz) and where we have given a guarantee. For slight negligence, we are liable only for breaches of essential contractual obligations (obligations that make the proper performance of the contract possible and on which you may regularly rely), and then only for the foreseeable damage typical of this kind of contract. Otherwise, our liability is excluded. These limits also apply to our employees and agents. Where Craeft is provided free of charge, we are liable only for intent and gross negligence, except for injury to life, body or health.
14Ending the contract
Either side can end the contract at any time by email, unless we've agreed a fixed term. The right to terminate for good cause remains. When the contract ends, Craeft stops making changes to your website. On request, we give you a copy of your website, including the changes made with Craeft, so you can host it elsewhere. You can ask us to delete your organisation's data, as described in the privacy policy.
15Law and courts
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant, a legal entity under public law or a special fund under public law, the courts at our registered office have exclusive jurisdiction; we may also bring proceedings at your registered office. If any provision of these terms is invalid, the rest remain in force.
